By accessing and using VibeSwipe, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. These terms constitute a legally binding agreement between you and VibeSwipe.

2. Description of Service

VibeSwipe is a platform that allows users to discover and interact with project ideas through a swiping interface. Users can browse and save project ideas for future reference. THE SERVICE IS PROVIDED STRICTLY “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OR GUARANTEES OF ANY KIND.

3. User Accounts

To access certain features of VibeSwipe, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. VIBESWIPE ASSUMES NO LIABILITY FOR ANY LOSS OR DAMAGE ARISING FROM YOUR FAILURE TO PROTECT YOUR ACCOUNT CREDENTIALS.

4. User Content

Users may submit project ideas to the platform. By submitting content, you grant VibeSwipe a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content for any purpose. VIBESWIPE MAKES NO GUARANTEES REGARDING THE CONFIDENTIALITY, SECURITY, OR INTEGRITY OF USER CONTENT.

5. Intellectual Property

Project ideas submitted to VibeSwipe remain the intellectual property of their respective creators. Users are prohibited from copying, implementing, or commercializing other users’ ideas without explicit permission from the idea creator. VIBESWIPE ASSUMES NO RESPONSIBILITY FOR AND MAKES NO WARRANTIES REGARDING THE ORIGINALITY, OWNERSHIP, SAFETY, OR COMMERCIAL VIABILITY OF ANY IDEAS SHARED ON THE PLATFORM.

6. Prohibited Conduct

Users agree not to:
  • Submit false, misleading, or fraudulent content
  • Harass or harm other users
  • Attempt to gain unauthorized access to the service
  • Use the service for any illegal purposes
  • Scrape or collect data from the service without permission

7. Privacy

Your use of VibeSwipe is also governed by our Privacy Policy. By using the service, you consent to the collection and use of your information as described in the Privacy Policy. VIBESWIPE MAKES NO GUARANTEES REGARDING THE SECURITY OF YOUR PERSONAL INFORMATION.

8. Modifications and Termination

VIBESWIPE RESERVES THE RIGHT, AT ITS SOLE DISCRETION AND WITHOUT ANY OBLIGATION OR LIABILITY, TO:

  • MODIFY, SUSPEND, OR DISCONTINUE THE SERVICE (OR ANY PART THEREOF) AT ANY TIME, WITH OR WITHOUT NOTICE
  • LIMIT OR RESTRICT ACCESS TO THE SERVICE
  • DELETE OR REMOVE ANY CONTENT OR USER ACCOUNTS
  • MODIFY OR CHANGE THESE TERMS OF SERVICE
YOU AGREE THAT VIBESWIPE SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION, OR DISCONTINUANCE OF THE SERVICE OR ANY PART THEREOF.

9. Disclaimer of Warranties and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE
  • VIBESWIPE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE
  • VIBESWIPE MAKES NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • VIBESWIPE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES
  • IN NO EVENT SHALL VIBESWIPE’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE

10. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS VIBESWIPE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY’S FEES) ARISING FROM: (A) YOUR USE OF THE SERVICE; (B) YOUR VIOLATION OF THESE TERMS; (C) YOUR VIOLATION OF ANY THIRD PARTY RIGHT, INCLUDING WITHOUT LIMITATION ANY COPYRIGHT, PROPERTY, OR PRIVACY RIGHT.

11. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VibeSwipe operates, without regard to its conflict of law principles. You agree that any legal action or proceeding between you and VibeSwipe shall be brought exclusively in the courts located in said jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
